Agreeing to these terms

These terms cover your use of the Mason City Concrete website and any estimate or work you ask us for. When you use this site, call us or book a job, you agree to them, so please read them before you do.

If you don't agree with something here, please don't use the site, and call us at (641) 548-3348 so we can talk it through before any work is planned.

What we do

Mason City Concrete is a concrete contractor based in Mason City, IA. We pour driveways, patios, sidewalks, steps, garage floors and other flatwork, which covers the flat slabs around a house. We also build footings, foundations and retaining walls, and we do stamped and decorative work, concrete cutting and foundation raising. We work in Mason City, Clear Lake, Charles City and the cities around them.

The service descriptions on the home page and the rest of the site are general information. They aren't an offer to do any job at any price, and what we'll actually do on your property is set by your written estimate or contract. You can read more about our crew on the About page.

Estimates and pricing

We give free quotes on site, with no pressure to book, because we can't price a slab properly until we've seen the ground it'll sit on, where the water runs and how much digging out the job needs. Your estimate lists the work we've agreed to do and what it costs.

An estimate is based on what we can see at the time. If we open up the ground and find something nobody could see beforehand, like soft or wet subgrade, which is the soil a slab sits on, buried debris or old concrete under the sod, we'll stop, show you and agree any change in price with you before we go on.

Prices on an estimate hold for the period written on it. After that, material costs may have changed, so we may need to update the figure before we schedule your pour.

Scheduling, weather and cancellation

We schedule pours around the weather, because rain, frozen ground or extreme heat can ruin fresh concrete and leave a weak surface later. If conditions aren't right on your day, we'll move the job to the next good date and let you know as early as we can. A weather delay isn't a breach of these terms by either of us.

If you need to cancel or move your job, tell us as soon as you can. If we've already ordered concrete, rebar or other materials, or done prep work like digging out and packing the base, you'll owe what we've spent up to that point, as your contract sets out.

Your new concrete needs time to cure, which is the wait while it hardens to full strength before it can take traffic. We'll tell you when it's ready to walk on and when it's ready to drive on, and you'll need to keep people, pets and vehicles off it until then.

Payment

The amount you owe, any deposit and when each payment is due are written in your estimate or contract. Unless it says otherwise, the balance is due when the work is finished.

If a payment is late, we may stop work until it's paid, and we may recover reasonable collection costs where Iowa law allows. If you have a question about a bill, call us before the due date so we can sort it out.

Your part of the job

We need clear access to the work area, and we need you to tell us about anything buried on your property that we wouldn't know about, like sprinkler lines, drain tile or private wiring. Public utilities must be marked before we dig, and we'll arrange that.

After the pour, how you treat the slab matters. Heavy trucks or equipment beyond what the slab was built for, harsh de-icing chemicals and water draining onto it from downspouts can all damage concrete, and we aren't responsible for damage they cause.

Warranty and what concrete can't promise

We're fully licensed and insured, and our work is backed by our satisfaction guarantee. If your job comes with a specific warranty, it'll be written into your contract, and that written warranty is the only one that applies.

Concrete shrinks as it cures and moves with the ground through Iowa winters, so some fine cracking is normal and isn't a defect. We cut control joints, which are planned grooves that give the slab a place to crack where you won't notice it, but no contractor can promise a slab that never cracks.

Color and texture can vary from one pour to the next and from samples or photos, and a broom finish, the light texture that keeps a slab from getting slick, won't look perfectly even. Apart from the warranty in your contract, the site and our work are provided without other promises, to the extent Iowa law allows.

Limits on our liability

To the extent Iowa law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect or follow-on losses, like lost use of your property or damage from conditions that were hidden underground and not reasonably visible when we quoted.

We also aren't responsible for problems caused by weather we couldn't control, by changes someone else makes to the slab or the ground around it, or by use the work wasn't built for. Nothing here limits any right you have that Iowa law doesn't let us limit.

If we disagree

If something about your job isn't right, call us first, because most problems get settled faster by walking the job together than by anything formal. Tell us what you're seeing, and we'll come look at it.

If we can't settle it that way, we both agree to try mediation in good faith before going to court. If that doesn't resolve it, the dispute will be heard in the state courts of Iowa in the county where the work was done.

Which law applies

These terms and any work we do for you are governed by the laws of the State of Iowa, without regard to rules that would apply another state's law.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the one that applies to the site. The terms in place when you sign your contract are the ones that apply to your job, unless we both agree in writing to change them.

If any part of these terms is found unenforceable, the rest still applies.
